What is constructive notice?
Constructive notice is a legal principle that assumes someone knows certain information simply because they had access to it, whether they actually read it or not. For HOAs, this usually means a homeowner is presumed to know the community’s rules because those rules are part of their purchase contract and the public record.
Why does constructive notice matter?
This principle is exactly why “I never read the CC&Rs” doesn’t hold up as a defense against a violation notice. It protects a board’s ability to enforce rules consistently, without needing to prove every homeowner personally read every page.

This concept mostly comes up when a rule enforcement dispute escalates far enough that a lawyer gets involved, since it’s the legal backbone of “the rules applied to you whether you read them or not.”
