What is due process?
Due process is the legal requirement that HOAs enforce rules, impose penalties, and resolve disputes using agreed-upon procedures, applied fairly and consistently. Community rules have to be reasonable, and decisions about violations can’t be discriminatory or arbitrary.
Why does due process matter?
Skipping due process, even with good intentions, is how a legitimate rule enforcement decision turns into a legal liability. Following a documented, consistent process protects the board just as much as it protects the resident on the receiving end of a violation notice.
