What is due process?

Due process means following the notice and hearing procedures already written into an HOA’s governing documents before a fine or penalty takes effect, not deciding a violation happened and moving straight to enforcement. Some states go further, California, for example, now requires a mandatory cure period before a hearing can even be scheduled.
