HOA Rule Enforcement Policy

What is an HOA rule enforcement policy?

An HOA rule enforcement policy has to follow a set hierarchy, state and federal law first, then the CC&Rs, then the bylaws, then the board’s own day-to-day rules, none of which can contradict the ones above it. Enforcement built on that hierarchy, rather than a vague catch-all rule, is what holds up when a resident pushes back.

Why does an HOA rule enforcement policy matter?

A board that fines one resident quickly while letting a similar violation from someone else slide is inviting a selective-enforcement claim and real legal exposure. Following the same documented process every time, no exceptions for who’s involved, is a board’s strongest protection against that kind of dispute.
