Lease Agreement

What is a lease agreement?

A lease agreement is the contract between a condo owner and a tenant that outlines the terms of the tenancy, rent, duration, responsibilities, and any rules the tenant needs to follow as a resident of the community.

Why does a lease agreement matter?

For HOAs, what’s in a tenant’s lease matters because the tenant, not just the owner, is the one actually living by the community’s rules day to day. A lease that doesn’t reference the HOA’s governing documents can leave a tenant genuinely unaware of restrictions that apply to them.

When You’ll Run Into This

This becomes relevant the moment an owner rents out their unit, and it’s worth the HOA confirming the lease references community rules before move-in, not after a violation.
