Bylaws

What is HOA bylaws?

Bylaws are the rules that govern how an HOA actually operates day to day, how officers get elected, how meetings are run, how decisions get made. They’re different from CC&Rs, which govern what homeowners can and can’t do with their property; bylaws govern how the board itself functions.

Why does HOA bylaws matter?

A board that doesn’t know its own bylaws is flying blind on basic questions, how many votes does it take to pass something, who’s actually allowed to call a special meeting. Every resident should be able to read the bylaws and understand exactly how their community is run.

When You’ll Run Into This

Bylaws usually get pulled out and reread the moment someone challenges how the board is operating. Our guide to how to amend HOA bylaws covers what to do once you’ve found a rule that no longer fits.
