Lien Rights

What is lien rights?

Lien rights are the legal rights that let a lender, or in an HOA context, the association, claim a stake in a property if a debt goes unpaid, forming the legal basis for filing a lien in the first place.

Why does lien rights matter?

Knowing exactly what lien rights an HOA’s governing documents grant it shapes how confidently a board can pursue unpaid dues. Some communities have broader lien rights written into their documents than others.
