Lien Rights

What is lien rights?

Lien rights are the legal rights that let a lender, or in an HOA context, the association, claim a stake in a property if a debt goes unpaid, forming the legal basis for filing a lien in the first place.

Why does lien rights matter?

Knowing exactly what lien rights an HOA’s governing documents grant it shapes how confidently a board can pursue unpaid dues. Some communities have broader lien rights written into their documents than others, and state law sets its own limits on top of that, so what one association can do about a delinquent account may not be available to a similar association a few states over.
